{"id":21778,"date":"2022-12-10T11:43:42","date_gmt":"2022-12-10T16:43:42","guid":{"rendered":"https:\/\/www.democracydocket.com\/?post_type=cases&#038;p=21778"},"modified":"2024-11-07T18:15:45","modified_gmt":"2024-11-07T23:15:45","slug":"arizona-secretary-of-state-and-3rd-congressional-district-election-contests","status":"publish","type":"cases","link":"https:\/\/www.democracydocket.com\/cases\/arizona-secretary-of-state-and-3rd-congressional-district-election-contests\/","title":{"rendered":"Arizona Secretary of State and 3rd Congressional District Election Contest"},"content":{"rendered":"\n<p>Election contest filed by Mark Finchem, the GOP candidate for Arizona secretary of state who <a href=\"https:\/\/ballotpedia.org\/Arizona_Secretary_of_State_election,_2022\" target=\"_blank\" rel=\"noreferrer noopener\">lost<\/a> to Secretary of State-elect Adrian Fontes (D) by over five points, and Jeff Zink, the GOP candidate for Arizona\u2019s 3rd Congressional District who <a href=\"https:\/\/ballotpedia.org\/Arizona%27s_3rd_Congressional_District_election,_2022\" target=\"_blank\" rel=\"noreferrer noopener\">lost<\/a> in a landslide to Rep. Ruben Gallego (D-Ariz), against Fontes, Gallego and current Arizona Secretary of State Katie Hobbs (D). The plaintiffs allege that widespread failures in the state\u2019s conduct of the midterm elections, specifically in Maricopa County, cost Finchem and Zink their elections and \u201chas resulted in Arizona becoming a laughingstock among the 50 states.\u201d The plaintiffs specifically point to issues with tabulator machines in Maricopa County to argue that \u201cArizona voters experienced monumental difficulties trying to register their votes\/ballots\u201d and the alternatives offered to affected voters were \u201cweak and unsatisfying\u201d and these votes \u201cwere likely never counted and constitute the 60,000 Maricopa County and 20,000 Pima county missing votes reported on the Secretary of State website.\u201d The contest places blame for these issues on Hobbs, suggesting that she \u201chad an ethical duty to recuse herself\u201d because she \u201cwas herself running for governor\u201d while being the state\u2019s chief election officer. According to the plaintiffs, \u201crecusal would cause her to lose control of the election she hoped to directly benefit from &#8211; a staggering appearance of impropriety and display of unethical behavior,\u201d causing Arizona to have \u201cthe only mid-term election in the 50 states with such a comical and tragic outcome.\u201d The plaintiffs further suggest that Hobbs failed to \u201cproperly investigat[e]\u201d the tabulator machines that experienced issues on Election Day; she threatened and intimidated county-level election workers in Cochise and Mohave counties and she used Twitter \u201cto censor the free speech of Arizona citizens because of \u2018misinformation\u2019 [that] offended her political perspective.\u201d <\/p>\n\n\n\n<p>Without all of these alleged violations of Arizona law, the plaintiffs argue that \u201c201,232 votes would have gone to Finchem and 79,298 votes would have gone to Zink, changing the outcome of the election in favor of Plaintiffs.\u201d The contest asks the court to declare that the election of Fontes and Gallego \u201cis of no further legal force or effect and that the election is annulled,\u201d order ballots to be inspected for fraud, require a \u201cstate-wide special election, counted by hand, without the use of electronic vote tabulation systems at the precinct level, [and] no mail in ballots\u201d and open an investigation into Hobbs\u2019 conduct for allegedly violating Arizona law. On Dec. 12, the plaintiff filed an amended complaint removing Zink as a plaintiff and Rep. Gallego as a defendant in the case. <\/p>\n\n\n\n<p>On Dec. 16, the court dismissed the lawsuit. On Dec. 21, Finchem appealed the trial court&#8217;s order dismissing the lawsuit to the Arizona Supreme Court. On Dec. 29, the Arizona Supreme Court denied the appeal.<\/p>\n\n\n\n<p>On Aug. 1, 2023, Finchem voluntarily dismissed his appeal in the Arizona Court of Appeals. <\/p>\n\n\n\n<p><strong>RESULT:<\/strong> On Nov. 7, 2024, the state Supreme Court denied Finchem&#8217;s petition for review.
