{"id":28576,"date":"2023-08-02T12:21:20","date_gmt":"2023-08-02T16:21:20","guid":{"rendered":"https:\/\/www.democracydocket.com\/?post_type=cases&#038;p=28576"},"modified":"2026-05-05T13:53:54","modified_gmt":"2026-05-05T17:53:54","slug":"colorado-unaffiliated-voters-primary-challenge","status":"publish","type":"cases","link":"https:\/\/www.democracydocket.com\/cases\/colorado-unaffiliated-voters-primary-challenge\/","title":{"rendered":"Colorado Unaffiliated Voters Primary Challenge"},"content":{"rendered":"\n<p>Lawsuit filed on behalf of the Colorado Republican Party (CO GOP) challenging <a href=\"https:\/\/ballotpedia.org\/Colorado_Unaffiliated_Elector,_Proposition_108_(2016)\" target=\"_blank\" rel=\"noreferrer noopener\">Proposition 108<\/a> \u2014 a proposition that allows unaffiliated voters to vote in partisan primaries without declaring an affiliation to that party \u2014 alleging that the proposition violates the First and 14th Amendments of the U.S. Constitution. As of <a href=\"https:\/\/www.sos.state.co.us\/pubs\/elections\/VoterRegNumbers\/2023\/July\/VotersByPartyStatus.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Aug. 1<\/a>, 47% \u2014 or 1.82 million of Colorado\u2019s 3.88 million registered voters \u2014 are unaffiliated, making unaffiliated voters the largest group of voters in the state.&nbsp;<\/p>\n\n\n\n<p>The plaintiff argues that Proposition 108 violates the CO GOP\u2019s right to free speech \u201dby forcing its political association to deem as its nominee for office a candidate chosen in an open primary election in which unaffiliated voters are allowed to participate.\u201d The plaintiff further alleges that allowing unaffiliated voters to vote in partisan primaries violates the 14th Amendment by \u201cdiluting\u201d the \u201cvotes cast by [the CO GOP\u2019s] members when the party has not determined for itself to permit voting by those who are not affiliated with, and have deliberately chosen not to affiliate with, the party.\u201d The plaintiff also asserts that Proposition 108 imposes \u201cdifferential treatment,\u201d which in turn \u201cinfringes upon the fundamental voting rights of major political parties and the voters affiliated with them.\u201d&nbsp;<\/p>\n\n\n\n<p>The plaintiff requests that the court block the enforcement of Proposition 108 and declare it unconstitutional.<\/p>\n\n\n\n<p>On Feb. 4, 2024, the CO GOP&#8217;s request to temporarily block the law was denied. <\/p>\n\n\n\n<p>On March 31, 2026, the court <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2023\/08\/130-2026-03-31-Order.pdf\" data-type=\"link\" data-id=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2023\/08\/130-2026-03-31-Order.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> in part the Colorado GOP&#8217;s motion for summary judgment, finding Proposition 108&#8217;s &#8220;opt-out&#8221; provision unconstitutional. The &#8220;opt-out&#8221; provision allows parties to opt out of the semi-open system only if three-fourths of the party\u2019s state central committee votes to switch to an assembly or convention-based nomination process.<\/p>\n\n\n\n<p><strong>STATUS:<\/strong> On April 28, 2026, the court <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2023\/08\/153-2026-04-28-Order.pdf\" data-type=\"link\"
