{"id":70171,"date":"2026-06-02T16:18:55","date_gmt":"2026-06-02T20:18:55","guid":{"rendered":"https:\/\/www.democracydocket.com\/?post_type=alerts&#038;p=70171"},"modified":"2026-06-02T16:18:55","modified_gmt":"2026-06-02T20:18:55","slug":"trump-order-targeting-mail-voting-leaves-judge-very-concerned","status":"publish","type":"alerts","link":"https:\/\/www.democracydocket.com\/news-alerts\/trump-order-targeting-mail-voting-leaves-judge-very-concerned\/","title":{"rendered":"Trump order targeting mail voting leaves judge \u2018very concerned\u2019\u00a0"},"content":{"rendered":"\n<p>A federal judge in Massachusetts seemed skeptical of President Donald Trump\u2019s executive order attacking mail-in voting, which, if allowed to stand, could have enormous consequences on the midterm elections.<\/p>\n\n\n\n<p>U.S. District Judge Indira Talwani, an Obama appointee, expressed concern during a hearing Tuesday that the order poses a serious risk of unconstitutionally disenfranchising eligible voters, according to <a href=\"https:\/\/www.reuters.com\/legal\/government\/boston-judge-weigh-blocking-trumps-mail-in-voting-executive-order-2026-06-02\/\" target=\"_blank\">reporting<\/a> by Reuters.\u00a0<\/p>\n\n\n\n<p>The order, <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/ensuring-citizenship-verification-and-integrity-in-federal-elections\/\" target=\"_blank\">signed<\/a> by Trump in March, tasks the U.S. Department of Homeland Security and the Social Security Administration with creating a nationwide voter eligibility list \u2014 and then directs the U.S. Postal Service to restrict the delivery of mail-in ballots based on that list. Voting rights advocates and legal experts universally agreed that such a decree is unconstitutional, as states \u2014 not the executive branch \u2014 hold the power to administer elections.\u00a0<\/p>\n\n\n\n<p>The order was met with a barrage of lawsuits, including the one Talwani heard Tuesday, <a href=\"https:\/\/www.democracydocket.com\/cases\/trump-mail-in-voting-executive-order-challenge-state-ags\/\" target=\"_blank\">filed<\/a> by attorneys general from 22 states and Washington, D.C., as well as a coalition of pro-voting groups, seeking to block the order.\u00a0<\/p>\n\n\n<div class=\"sign-up\n\t\">\n\t<div class=\"sign-up__inner\">\n\t\t<div class=\"sign-up__header\">\n\t\t\t\t\t\t\t<span class=\"sign-up__eyebrow text--h6\">\n\t\t\t\t\tSIGN UP TODAY\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<h2 class=\"sign-up__title text--h1\">\n\t\t\t\t\tGet updates straight to your inbox \u2014 for free\t\t\t\t<\/h2>\n\t\t\t\t\t\t\t\t\t\t<div class=\"sign-up__desc\">\n\t\t\t\t\t<p>Join 350,000 readers who rely on our daily and weekly newsletters for the latest in voting, elections and democracy.<\/p>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<div class=\"sign-up__form\">\n\t\t\t<script type=\"text\/javascript\" src=\"\/\/js.hsforms.net\/forms\/embed\/v2.js\"><\/script><script>hbspt.forms.create({ region: \"na1\", portalId: \"48216804\", formId: \"edec34b6-42b8-45e1-81d7-ef15f8bdee00\" });<\/script>\t\t<\/div>\n\t<\/div>\n<\/div>\n\n\n\n<p><\/p>\n\n\n\n<p>\u201cMail voting helps millions of Americans participate in our democracy, including seniors, voters with disabilities, military families, students, caregivers, and working people,\u201d Marcia Johnson, chief of activation and justice for the League of Women Voters \u2014 one of the plaintiffs in the case \u2014 said in a statement. \u201cNo president has the authority to unilaterally rewrite election rules or dictate how states administer their elections.\u201d<\/p>\n\n\n\n<p>During the motion hearing in Boston, Talwani seemed unsure if it would even be possible for the federal government to create a full and accurate national voter list, which would be reason to block the order.&nbsp;<\/p>\n\n\n\n<p>&#8220;What\u2019s the harm if I say no one can use this list for the November election?&#8221; \u200bTalwani reportedly asked.<\/p>\n\n\n\n<p>Sophia Lakin, an attorney for the American Civil Liberties Union \u2014 one of the pro-voting plaintiffs in the case \u2014 told Democracy Docket that Talwani was also fixated on resolving the matter quickly, given how close it is to the general election.<\/p>\n\n\n\n<p>\u201cShe was very concerned and focused on timing and how close we are to the midterm election, with primaries along the way,\u201d Lakin said.<\/p>\n\n\n\n<p>Lakin also said Talwani emphasized the need for a speedy ruling, to \u201cmake sure that there&#8217;s an opportunity for us to seek judicial review,\u201d given the likelihood that Trump\u2019s anti-mail voting order makes its way to the U.S. Supreme Court before the November midterms.&nbsp;<\/p>\n\n\n\n<p>Talwani isn\u2019t the first judge to hear a challenge to the anti-mail voting order.
