Down one, she wrote, was \u201can orderly election, held under a tried-and-tested congressional map that protects Black Alabamians\u2019 right to vote and with which all voters, elections officials, and candidates alike are familiar.\u201d<\/p>\n\n\n\n<p>Down the second path was \u201ca chaotic election, held under a never-before-used congressional map that intentionally discriminates against Black Alabamians,\u201d she said.&nbsp;<\/p>\n\n\n\n<p>\u201cThe majority chooses the second path and disregards both democratic values and the rule of law. I respectfully dissent.\u201d<\/p>\n\n\n\n<p>In addition to being wrong on the merits, the court\u2019s decision \u201cinflicts two grave harms on the public,\u201d Sotomayor wrote.<\/p>\n\n\n\n<p>\u201cIt debases the democratic process by upending Alabama\u2019s entire election in the name of permitting Alabama to discriminate against Black Alabamians,\u201d she wrote. \u201cIt also corrodes the rule of law by rewarding Alabama\u2019s gamesmanship and outright defiance of court orders.\u201d<\/p>\n\n\n\n<p>Sotomayor also noted that the ruling \u201ctramples on\u201d the court\u2019s <a href=\"https:\/\/www.democracydocket.com\/purcell\/\" target=\"_blank\">Purcell principle<\/a>, which has held that courts should not change voting or election rules too close to an election to avoid confusion for voters and election officials.<\/p>\n\n\n\n<p>\u201cThe Court\u2019s decision will cause havoc,\u201d Sotomayor wrote. She added that county elections officials will have to reassign hundreds of thousands of voters across Alabama to new congressional districts, a process the state previously said \u201cwould take months.\u201d<\/p>\n\n\n\n<p>In total, as many as 600,000 voters, or roughly 15% of the state\u2019s registered voters, could be affected by the court\u2019s ruling.<\/p>\n\n\n\n<p>&#8220;Now the Court is squarely faced with a record of the turmoil it has caused and the harm it has wrought.
